To Top Terms & Conditions of Purchase

These terms and conditions (which shall only be waived in writing by SAI Global) prevail over all conditions imposed by the customer and shall be binding upon any SAI Global Retail Merchandising Order placed by the customer.

To Top Terms of Sale

The goods and all other products sold by SAI Global pursuant to any SAI Global Retail Merchandising Order are sold subject to these terms and conditions.

To Top Delivery

(a) The delivery times made known to the customer by SAI Global are estimates only and SAI Global shall not be liable for late delivery or non-delivery.

(b) SAI Global is not liable for any loss, damage or delay occasioned to a customer arising from late or non-delivery of goods.

(c) SAI Global may, at its option, deliver the ordered goods to the customer in any number of instalments unless agreed otherwise in writing.

To Top Loss or Damage in Transit

SAI Global is not responsible to the customer or any person claiming through the customer, for any loss or damage to goods in transit caused by any event of any kind by any person.

To Top Prices

(a) Unless otherwise stated, all prices quoted by SAI Global are inclusive of GST.

(b) The prices quoted in the SAI Global Retail Merchandising Order are those prices ruling at the date of issue of the order form.

(c) If SAI Global makes any alterations to the price of the goods either before acceptance of or prior to delivery of the goods, those alterations are to the customers account.

To Top Payment

(a) The purchase price for goods of less than $2,000, (being the value of the order plus any set up fee), must be paid within 14 days following delivery of the goods unless other terms of payment are expressly agreed in writing between SAI Global and the customer.

(b) The purchase price for goods of $2,000 or more must be paid at the time of order unless otherwise agreed in writing.

To Top Rights in Relation to Goods

SAI Global reserves the following rights in relation to the goods until all accounts owed by the customer to SAI Global are fully paid:

(a) Ownership of the goods;

(b) To enter the customers premises without liability for trespass and retake possession of the goods; and

(c) To keep or resell any goods repossessed pursuant to (b) above.

To Top Storage

SAI Global reserves the right to make a reasonable charge for storage if delivery instructions are not provided by the customer within 7 days of a request by SAI Global for such instructions.

To Top Returned Goods

SAI Global is not under any duty to accept goods returned by the customer and will do so only on terms to be agreed in writing in each individual case.

To Top Goods Sold

All goods to be supplied by SAI Global to the customer are as described on the SAI Global Retail Merchandising Order agreed by SAI Global and the customer and the description on such order modified as so agreed prevails over all other descriptions including any specification or inquiry of the customer.

To Top Cancellation

No order may be cancelled except with SAI Global's consent in writing and on terms which will indemnify SAI Global against all losses.

To Top Place of Contract

Any orders made by the customer shall be made in the state or territory of Australia from which the order is issued and parties shall submit to all disputes arising between them to the courts of such state or territory.

To Top Displaying the StandardsMark or other Certification Marks

Displaying the StandardsMark or other Certification Marks Under consumer protection legislation such as the Trade Practices Act, 1974 Commonwealth and state based Fair Trading Acts, companies can be prosecuted for making false or misleading representations about the goods or services that they offer. It is therefore important to ensure that Certification Marks are not used in a misleading manner. Listed below are some issues that you may wish to consider when you are displaying Certification Marks on your promotional materials.

To Top How to display your Management System Certification Mark

The StandardsMark, or any other Management System Certification Mark tells your potential customers and stakeholders that you are committed to meeting their expectations and that you have an internationally recognised system in place to manage your risks & improve your performance. Naturally the message you tell your customers will vary according to the type of certification you have attained.

  • Management system certification is site specific. If your certification only covers some of your company's sites, make sure that this is clear whenever you use the Certification Mark. For example use of the Certification Mark on corporate letterhead could be misleading if not all sites addresses on the letterhead are covered by the certification.
  • Your management system certificate clearly sets out the scope of your certification. Ensure that if some of your company's activities are not covered by the certified system that this is taken into account when using the Certification Mark.
  • Management system certification is not a statement about the specific standard of performance of goods or services provided by your company; it only relates to the management system that is in operation. For this reason Management System Certification Marks must not be used on products or in any way that implies product conformity. In certain circumstances use of Certification Marks on external packaging, stickers or swing tags may bepermissible - but this should be avoided if the overall effect is likely to mislead or deceive the consumer. And to save time, money the energy in the correcting of signage, it is recommended that you seek approval from SAI Global prior to finalising artwork

To Top How to display your Product Certification Mark

In contrast to a Management System Mark, Product Certification Marks tell your potential customers and stakeholders that you have the capability to produce a product which consistently meets a specific standard. Use of the Certified Product Certification Mark is a statement about the specific standard to which goods provided by your company are produced.

For maximum benefit Product Certification Marks should be displayed on the product itself. In some cases, such as for consumer safety products where there may be a requirement to serially mark product and batches, SAI Global sells serially marked labels which can be attached directly to the product (see order form enclosed). In cases where labels are not sold, licensees may apply the Certification Mark to the product in a manner that suits their production process. The method must be agreed with SAI Global as part of the certification process.

Most importantly, Product Certification Marks must be accompanied by the number of the standard or specification to which the product has been certified. This information means that the consumer can, if they wish, check the content of the standard to ensure that the certification covers the important product attributes from their point of view. Also, because it is the manufacturer of the product who is the licensee, the Mark and Licence number should be displayed in proximity to the manufacturer's name.

  • Product Certification applies to specific product models. If you are using certification Marks in advertising, make sure that you have clearly indicated which products are certified. Use of the Product Certification Marks in a general advertisement or in a product catalogue can sometimes wrongly imply that all products in a range are certified. Don't forget that you may be misleading a consumer unintentionally which could still get you in trouble!

  • Colour is important. You may use Certification Marks in colours other than the normal specific registered colours to fit in with your printing requirements. However there are limitations, please avoid using red, green and orange as substitute colours to avoid confusion with other SAI Global Certification Marks. Some common PMS colours used in SAI Global's Certification Marks include: PMS 032 Red, PMS 3282 Green, PMS 123 Orange/Mustard, PMS 285 Blue.
  • Location of the Certification Trade Mark can also be significant. To avoid misleading the market, do not make claims about a product or service and its performance directly adjacent to a Certification Mark if they deal with subjects not covered by the certification.

To Top Getting SAI Global approval

Under the Certification TradeMark Licence Terms and Conditions, certified companies are recommended to present proposed uses of Certification Marks to their SAI Global Client Manager (auditor) for approval prior to signing off artwork. When ordering through this merchandising catalogue you'll know that you are receiving the right merchandise, bearing a correctly positioned and approved logo and associated information. If however you chose to produce material personally, it always remains the responsibility of the licensee to ensure that the Certification Mark is not used in a manner which could be misleading.

To Top Displaying Your Certification Mark - Examples

Listed below are some examples of how Certification Marks are displayed. Use of Certification Marks on promotional products can be a very effective form of marketing promotion. This is generally acceptable to SAI Global provided that products (eg. caps, drink bottles, pens, umbrellas etc.) are not products within the certified company's normal product range. For example, a company which manufactures taps and other plumbing products and displays its Certification Mark on a T-shirt, is unlikely to be misleading the public.
